What is Mobile Notary?

A notary public is a public officer appointed and commissioned by the Governor whose function is to administer oaths (or affirmations); to take acknowledgments; to attest to the trueness of photocopies of certain documents; and to perform other duties specified by Florida law. In addition, notaries are required to be bonded. As an unbiased witness, it is our obligation to determine whether or not the person signing the document is willing and capable to understand it. A mobile notary is one who travels to their clients and notarizes documents at their location. We are here to help you wherever you need us including your home, office, hospital, coffee shop, restaurant, government facility, nursing home, airport, and more.

What type of documents can be Notarized?

We notarize signatures (not necessarily the document itself, which can be a common misunderstanding); the types of documents we may encounter on any given day are truly limitless. It doesn’t matter if the document has mistakes, what font, spacing, layout, is handwritten or typed or what language the documents were written as long as there is a place for you to sign, a signature can be notarized. The State of Florida notifies us that one of the only document-related conditions is that there must be no blank spaces on the documents in question prior to the notarization (except for the signature line), which means all initials, titles, dates, and other information must be completed prior to the notarization.

 What forms of identification do you accept?

According to the Secretary of State of Florida, a notary public must validate the identity of the signer on a document when completing an Acknowledgement or Jurat. Identity is established if the signer’s identity is submitted to the Notary Public with “satisfactory evidence”. Satisfactory evidence refers to the lack of evidence, information, or other circumstances that would lead a reasonable person to assume the person is not he or she claims to be.

From Subsection 117.05(5) of Florida Statutes, reasonable reliance on the presentation to the notary public of any of the following forms of identification, if the document is current or has been issued within the past 5 years and bears a serial or other identifying number.

  • A Florida identification card or driver’s license issued by the public agency authorized to issue driver’s licenses.

  • A passport issued by the Department of State of the United States.

  • A passport issued by a foreign government, if the document is stamped by the United States Bureau of Citizenship and Immigration Services.

  • A driver’s license or identification card issued by a public agency authorized to issue driver licenses in a state other than Florida, a territory of the United States, or Canada or Mexico.

  • An identification card issued by any branch of the armed forces of the United States.

  • An inmate identification card issued on or after January 1, 1991, by the Florida Department of Corrections for an inmate who is in the custody of the department.

  • An inmate identification card issued by the United States Department of Justice, Bureau of Prisons, of an inmate who is in the custody of the department.

  • A sworn, written statement from a sworn law enforcement officer that the forms of identification for an inmate in an institution of confinement were confiscated upon confinement, and that the person named in that document is the person whose signature is to notarized.

  • An identification card issued by the United States Bureau of Citizenship and Immigration Services.

  • Florida Laws provides two additional methods of identification to a person who does not have and cannot obtain acceptable identification. Most often this occurs when a person is an elderly person, a minor child, or a person with a disability.

    a. The sworn written statement of one credible witness personally known to the notary public.

    b. The sworn written statement of two credible witnesses whose identities are proven to the notary public upon the presentation of satisfactory evidence that each of the following is true.

    • That the person whose signature is to be notarized is the person named in the document.

    • That the person whose signature is to be notarized is personally known to the witnesses.

    • That is the reasonable belief of the witnesses that the circumstances of the person whose signature is to be notarized are such that it would be very difficult or impossible for that person to obtain another form of identification.

    • That is the reasonable belief of the witnesses that the person whose signature is to be notarized does not possess any of the identification documents specified in Section 117.05(5)(b)(2), Florida Statutes; and

    • The witnesses do not have a financial interest in nor are parties to the underlying transaction.

Can you pre-sign the documents before meeting with us?

Yes and no; it all depends on the type of Notarization requested. We typically perform two different types of notarizations. The first is an Acknowledgement and the other is a Jurat. The Acknowledgement is used to confirm the identification of a person’s signature on a document as well as acknowledge that the person personally appeared before the Notary. The Jurat, on the other hand, certifies that the person’s identity is legitimate and that they appeared in front of the Notary, as well as that they made a sworn statement (provided by the Notary) in person regarding the document or statement in question. There is a slight difference between the two types of Notarization in that the Jurat needs personal appearance at the time of signing because an affirmation is given prior to signing. The Acknowledgement also requires personal appearance however it does not require the presence of the Notary to verify that the signatory has signed the document in person.

You might be wondering if this means you can do the Notarizations remotely if you are able to see my ID? Unfortunately, no. Since the two types of Notarization requires a physical appearance as well as the signing/thumbprinting of a public record (aka Notary journal), appearing in person is an absolute must in Florida.
